Heard learned counsel for petitioner and learned State Counsel appearing on behalf of the opposite parties. 2. Present petition under Article 226 of Constitution of India has been filed challenging order dated 15.07.2025 whereby petitioner has been transferred from District Hardoi to District Balia. 3. It is submitted that the impugned order of transfer is against the provisions of paragraph 5 of Government Order dated 06.05.2025 since it ignores not only the aspect of couple postings in view of petitioner's wife being employed at Lucknow but also the aspect of petitioner suffering from serious ailments as indicated in memorandum of petition and further more that he has less than two years to superannuated and therefore was required to be posted in terms of paragraph 5 (v) of aforesaid Government Order. 4. Since considering petitioner's grievance would entail factual aspects, liberty is granted to petitioner to file fresh representation before opposite party no.2 i.e. Consolidation Commissioner, U.P. Indira Bhawan, Lucknow. In case such a representation is filed, the same is required to be decided by authority concerned expeditiously by a reasoned and speaking order within a period of two weeks from receipt of representation of petitioner along with a certified copy of this order. The authority may consider petitioner's posting either at Lucknow or at a nearby District, in case possible. 5. With aforesaid direction, the petition stands finally disposed of.
