The petitioner has moved before this Court for grant of privilege of anticipatory bail from apprehending his arrest in connection with Telaiya P.S. Case No.95 of 2023 registered for the offences under Sections 147, 148, 341, 325, 379, 504 and 506 of the Indian Penal Code. 3. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case without any cogent and reliable evidence against him. He further submits that the petitioner has been implicated only to harass him due to prior enmity with the informant’s son and the petitioner is not named in the First Information Report. He further submits that the petitioner was not present at the place of occurrence; the allegation is general and omnibus in nature; no incriminating article has been recovered from the possession of the petitioner. He further submits that the petitioner is ready to abide by all the terms and conditions as imposed by this Court. 4. Learned A.P.P. opposes the prayer for anticipatory bail of the petitioner. 5. Having regard to the facts of the case and looking to the allegations made against this petitioner coupled with the fact that the petitioner is not named in the FIR; therefore, I am inclined to enlarge this 2025:JHHC:14393 2 petitioner on anticipatory bail. Accordingly, the petitioner is directed to surrender before the court below within a period of four weeks from today and the learned court below on his surrender shall release him on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand Only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Koderma in connection with Telaiya P.S. Case No.95 of 2023. 6. It is made clear that the petitioner shall cooperate with the investigation/trial and if he will not cooperate with the investigation/trial, the State shall be at liberty to take appropriate action.
