Neutral Citation No. - 2025:AHC-LKO:43190-DB Court No. - 2 Case :- WRIT - C No. - 7011 of 2025 Petitioner :- Najima And Another Respondent :- State Of U.P. Thru. Prin. Secy. Revenue Deptt. Lko. And 4 Others Counsel for Petitioner :- Meva Lal Yadav,Saddam Khan Counsel for Respondent :- C.S.C. Hon'ble Rajan Roy,J. Hon'ble Manish Kumar,J. Heard. The petitioner’s ‘bhumidhari’ land is alleged to have been encroached by opposite party no. 5, a private person, hence this petition seeking a direction to the opposite parties no. 2 to 4, who are official opposite parties. On being asked as to under which provision, the said official opposite parties can interfere in the matter, unless of course, an F.I.R. has been lodged, which may give a cause to the Police to interfere, learned Counsel could not assist us. The remedy for the petitioners is elsewhere and not under Article 226 of the Constitution of India, especially as, Shri Shailesh Tiwari, learned Standing Counsel informs that application of the petitioner for demarcation of the land has been rejected with the observation that first of all there has to be partition of the land, as there are several co-sharers. The petition is accordingly disposed of.
