CORAM: - HON’BLE MR. JUSTICE DEEPAK ROSHAN
------ For the Petitioners : Mr. Anupam Anand, Advocate For the State : Mr. Bhola Nath Ojha, Spl.P.P.
------ 02/Dated: 03.06.2025
Heard learned counsel for the parties.
2. The petitioners have moved before this Court for grant of privilege of anticipatory bail from apprehending their arrest in connection with Lawalong P.S. Case No. 13/2025 instituted under Sections 18, 27(a), 28, 29 & 30 of the N.D.P.S. Act and Section 33 of the Indian Forest Act.
3.
Learned counsel for the petitioners submits that the petitioners have been falsely implicated in the present case and have not committed any offence as alleged in the F.I.R. They were not at all involved in illegal cultivation of poppy plants. They have been roped in the present case merely on the basis of alleged confession of apprehended co-accused Golu Ganjhu. The land on which cultivation of poppy plants was allegedly found does not belong to the petitioners. It is further submitted that
similarly situated co-accused persons, namely, Manoj Kumar & Rajesh Kumar, have been granted anticipatory bail by the coordinate bench of this Court vide order dated 29.05.2025 in A.B.A. No.2911 of 2025. The petitioners have no criminal antecedent as has been stated in paragraph no.21 of the present anticipatory bail application.
4. Learned SpecialP.P. opposed the prayer for bail.
5. Having regard to the facts of the case, I am inclined to grant the privilege of anticipatory bail to the petitioners. Accordingly, the petitioners are directed to surrender in the Court below within four weeks from today and in the event of their arrest or surrender, they will be enlarged on bail on furnishing bail bonds of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Principal District & Sessions Judge, Chatra in connection with Lawalong P.S. Case No. 13/2025 with the condition that they will co-operate with the investigation of the case and appear before the investigating officer as and when noticed by him and furnish their mobile number and photocopy of the Aadhaar Card with an undertaking that they will not change their mobile number during the pendency of the case and subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. It is made clear that if the petitioners do not cooperate with the investigation/trial, the State would be at liberty to take appropriate action.
