Heard Mr. D.K. Baidya, learned counsel for the applicants-petitioners and Mr. R.R. Kaushik, learned Additional Public Prosecutor, Assam for the opposite party.

The instant application is preferred seeking impleadment of the informant who instituted the complaint, Complaint Case no. 652/2024 before the Court of learned Chief Judicial Magistrate, Morigaon alleging commission of offences under Sections 417/420/34, Indian Penal Code [IPC] against the applicants-petitioners. The said complaint was subsequently registered as Morigoan Police Station Case no. 12/2025 under Section 406, IPC and Section 420, IPC.
3. The particulars of the said opposite party no. 2-informant is mentioned in the cause-title of the application. The opposite party no. 2-informant has been sought to be impleaded as respondent no. 2 in the accompanying criminal petition, which has been preferred under Section 528 of the Bharatiya Nagarik Suraksha Sanhita [BNSS], 2023 seeking quashing of the FIR lodged by the opposite party no. 2-informant and registered as Morigaon Police Station Case no. 12/2025.
4. In view of the statements and averments made in this interlocutory application to the above fact, the instant interlocutory application is allowed.
5. Mr. Baidya, learned counsel for the applicants-petitioners shall file an amended Cause-Title in terms of the Notification no. 79 dated 19.06.2023 by tomorrow. On filing such amended cause- title by the learned counsel for the applicants-petitioners, the office to cause necessary correction in the cause-title of the petition as well as in the CIS.
