For the reasons stated in the affidavit filed in support of Restoration Application, the same is allowed. The order dated 29.08.2025 passed by this Court is hereby recalled and the Writ Petition is restored to its original number, subject to payment of cost of Rs.1,000/-, to be deposited with Uttarakhand High Court Bar Association Advocate’s Welfare Fund, within two weeks from today. 4. Petitioner’s father Vishambhar Singh Negi was employed as Security Guard in Oil and Natural Gas Corporation Limited, Dehradun, who passed away on 12.05.2021. Petitioner applied for compassionate appointment. His claim for compassionate appointment was disputed by one Ms. Dimple Negi, who contended that she is the legally wedded wife of late Vishambhar Singh Negi (father of the petitioner). 5. It transpires that Ms. Dimple Negi filed a suit claiming part of benefit of the retiral dues of late Vishambhar Singh Negi, which was registered as O.S. No. 456 of 2021; the said suit was decided in her favour by learned Family Court, Dehradun vide judgment dated 20.11.2024 and it was provided that 2025:UHC:11001 retiral dues shall be released in favour of daughter of Ms. Dimple Negi, namely- Pari Negi. 6. Petitioner is aggrieved by rejection order dated 21.02.2022. The rejection order is on record as Annexure-9 to the writ petition. Perusal thereof reveals that petitioner’s claim for compassionate appointment was not considered on account of interim order passed in O.S. No. 456 of 2021. 7. Since O.S. No. 546 of 2021 is now decided, as informed by learned counsel for the parties and learned counsel for the petitioner submits that a compromise has also been entered into between petitioner and Ms. Dimple Negi, who had opposed the prayer made by petitioner for compassionate appointment. 8. As per the compromise deed, Ms. Dimple Negi has undertaken to give NOC for compassionate appointment in favour of the petitioner, therefore, in view of changed circumstances, the petitioner is permitted to make fresh application for compassionate appointment to the competent authority. If he makes such application within three weeks from today, supported by NOC from Ms. Dimple Negi, the competent authority shall re-visit the issue and take decision in the matter, as per law, within eight weeks thereafter. 9. The writ petition is disposed of in the aforesaid terms.
