It appears that the petitioner's father, late Mr.D.Lazer, had been proceeded against under Section 87 of the Tamil Nadu Cooperative Societies Act, 1983, pursuant to which an award came to be passed. Apparently, the said award has not been challenged either by the petitioner or by his father, late Mr.D.Lazer, who passed away on 24.10.2021. 3. The case of the petitioner is that no surcharge proceedings were initiated against the petitioner's father, late Mr.D.Lazer, during his lifetime. Consequently, no notice with respect to the surcharge proceedings was issued either to the petitioner or to any of the other legal heirs of late Mr.D.Lazer, namely, the petitioner's mother, Dhanabakiam; _____________ Page No. 2 of 5 https://www.mhc.tn.gov.in/judis W.P.(MD) No.20295 of 2025 the petitioner's brother, Manoj Kumar; and the petitioner's grandmother, Thangammal, who is the mother of late Mr.D.Lazer. 4. The learned counsel for the petitioner submits that the impugned Notice of Sale dated 25.06.2025 was purportedly issued pursuant to the steps taken in E.P.No.56/2023-2024, notice of which has not been served on the petitioner. 5. Today, when the case is taken up for hearing, the learned Government Advocate for the respondents produced a communication dated 24.07.2025 sent by the second respondent, wherein it is stated that there is no proposal to proceed further with the impugned Notice of Sale dated 25.06.2025. Considering the same, this Writ Petition is liable to be closed.
