Jacob, learned counsel for the petitioner and Mr. Samarjit H., learned Government Advocate assisted by Mr. A. Bheigya Meitei, learned junior Government counsel on behalf of the State respondents. [2] By the present petition, the petitioner approached this Court for a direction to respondent No. 3, i.e. SDC, Heingang, Imphal East, Government of Manipur to conduct demarcation of the land of the petitioner as per law. It is submitted that the petitioner has already submitted an application dated 17-11-2023 to the Sub-Deputy Collector, Heingang, Imphal East for demarcation of the land, i.e. demarcating the boundary of the homestead land under Patta No. 212 (Old), 201 (New), covered by C.S. Dag No. 615, measuring an area of .06 acre, situated at revenue village No. 11-Laipham Khunou, Imphal East District, Manipur under Section 52 of MLR & LR Act, 1960. Thereafter, the petitioner submitted reminders dated 13-06-2024 and 14-06-2024 in this regard and the Sub-Deputy Collector, Heingang, vide letter dated 15-07-2024, addressed to the Superintendent of Police, Imphal West requested the requisition of armed security personnel NINGOM BAM VICTORIA Digitally signed by NINGOMBAM VICTORIA Date: 2025.07.28 17:27:08 +05'30' WP(C) No. 543 of 2024 for the purpose of land demarcation scheduled on 24-07-2024 at 10.00 a.m. and after that no progress is made. [3] Mr. P. Jacob, learned counsel for the petitioner, submits that the writ petition may be disposed of by directing respondent No. 3, i.e. SDC, Heingang to complete the demarcation proceedings as per law within a stipulated time. [4] Mr. Samarjit H., learned Government Advocate for the State respondents, submits that this Court may pass an appropriate order. [5] In the peculiar facts of the present case, this Court has considered the material on record. Demarcation is provided under Section 52 of MLR & LR Act, 1960. However, no definite time frame is provided in the Act for completion of demarcation. Due to non-fixation of stipulated period for disposal of demarcation, the demarcation proceedings are pending before the competent authority for a considerably long time. [6] In the circumstances, the writ petition is disposed of by directing respondent No. 3, i.e. SDC, Heingang, Imphal East to complete the demarcation proceedings as per law initiated on the application of the petitioner within a period of three months from the date of receipt of a copy of this order. [7] Furnish a copy of this order to the learned counsel appearing for the parties. [8] It is made clear that this Court does not express any opinion on the merit of the case for demarcation.
