1. Heard learned counsel for petitioner and learned State Counsel for opposite parties.
2. Petition has been filed challenging order dated 14th June, 2025 whereby petitioner currently employed as Fireman has been transferred from district Bareilly to district Kheri.
3. The primary ground of challenge is that petitioner's daughter is currently studying in Class 11th and petitioner's transfer would adversely hamper her studies since she would be due to appear in the Board's examination in two years.
4. It is submitted that petitioner has already given a representation to the authority concerned which may be directed to be decided.
5. Learned State Counsel has been provided written instructions dated 21st July, 2025, copy of which is taken on record and as per which petitioner has been posted in a particular place for past 18 years 10 months and has therefore been transferred in accordance with transfer policy.
6. Considering aforesaid facts and circumstances, it is evident that petitioner has spent more than 18 years of being posted in the district from which he has been transferred and therefore does not have a vested right for continuation of posting in a particular place.
7. However in view of the fact that petitioner's daughter is currently studying in Class 11th as evident from marks statement cum certificate issued by the Central Board of Secondary Education, liberty is granted to petitioner to make a fresh representation before the opposite party No.2 i.e. Director General Fire Services U.P. and Rescue Services, Lucknow who may consider and decide the same within a period of two weeks from the date a certified copy of this order is produced before the said authority.
Consideration may be made either to continue petitioner in same place or any adjoining district.
8. The petition stands disposed of.
