Upadhyaya, the learned counsel appearing on behalf of the petitioner. Mr. R. Hoque, the learned counsel appears on behalf of the respondent No.1. None has appeared on behalf of the respondent No.2. As regard the proforma respondents, no steps were taken by the petitioner inspite of obtaining a stay order from this Court. 2. Be that as it may, the instant proceedings have been filed challenging the order dated 27.05.2024 passed by the Court of Page No.# 5/6 the learned Civil Judge (Junior Division), Bilasipara in Misc.(J) Case No.166/2023 whereby an application filed under Order VI Rule 17 of the Code of Civil Procedure, 1908 (for short, ‘the Code’) for amendment of the plaint was rejected. 3. This Court has duly taken note of the application filed under Order VI Rule 17 of the Code by the petitioner who is the plaintiff as well as the impugned order. First of all, it is relevant to take note of that the trial of Title Suit No.84/2021 has already commenced. It is also relevant to take note of that on earlier occasion, another application was filed by the petitioner seeking amendment which was allowed, that too at a stage when the trial had commenced. This is the second application filed seeking amendment of the plaint. There is not a single whisper in the said application as regards the due diligence as to why this application could not be filed earlier. 4. Taking into account the above, this Court finds no ground to interfere with the order dated 27.05.2024 passed in Misc.(J) Case No.166/2023. 5. Accordingly, the instant petition stands dismissed. 6. The stay order dated 02.08.2024 passed by this Court is vacated. 7. Parties are directed to appear before the learned Trial Court Page No.# 6/6 on 02.06.2025 for further proceedings of the suit.
