1. Heard learned counsel for the petitioners, learned counsel appearing on behalf of respondent nos. 4 and 5, and the learned A.G.A. for the State-respondents.
2. The present writ petition has been filed by the mother of the minor corpus i.e. petitioner nos. 1 and 2 seeking issuance of a writ in the nature of habeas corpus, directing the respondent authorities to produce the minor corpus before this Court and to set her at liberty from the alleged illegal custody of respondent nos. 4 and 5, who are father and grand-mother of petitioner nos. 1 and 2 respectively.
3. In compliance with the order dated 19.03.2025, respondent nos. 4 and 5, along with the mother of the corpus, are present before this Court today. The petitioner no.1 and 2 (minor corpus) was produced on 19.03.2025 by respondent no.4 and 5. Upon a specific query by the Court, it has been stated by respondent no. 4 that the mother of the minor corpus, namely Smt. Afsana Khatoon, who has filed the present petition, has been residing at her matrimonial home with the corpus and the same fact has not been disputed by the mother of the corpus.
4. In light of the above deliberations, it appears that the grievance
raised in the writ petition stands redressed. As such, no further adjudication is required in the present proceedings.
5. Accordingly, the present writ petition is dismissed. Order Date :- 21.4.2025 A. Tripathi Justice Vinod Diwakar Digitally signed by :- AKHILESH TRIPATHI High Court of Judicature at Allahabad
