Pratappur, District-Chatra ……… Petitioner -Versus- The State of Jharkhand ……… Opp. Party ----- CORAM : HON’BLE MR. JUSTICE RAJESH SHANKAR ----- For the Petitioner : Mr. Anupam Anand, Advocate : Mr. Pranav Kumar, Advocate For the State : Mr. Rajneesh Vardhan, A.P.P. ----- Order No.2 Date: 29.05.2025 1. The petitioner apprehending his arrest in connection with Pratappur P.S. Case No. 06 of 2025, for the offences punishable under Sections 115 (1), 121 (1), 132, 351 (2), 351 (3), 352 of the Bharatiya Nyaya Sanhita, 2023, pending in the Court of learned Sub Divisional Judicial Magistrate, Chatra, has prayed for grant of anticipatory bail. 2. Learned Counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has not committed any offence as alleged in the F.I.R. Even if the content of the written report is taken to be true, it has been alleged against the petitioner that he brought a tractor loaded with sand to the premises of the Circle Office, Pratappur in an unauthorised manner and also abused the Circle Officer i.e. the informant and obstructed him from discharging the duty. The entire allegation made in the F.I.R. is false and concocted. The petitioner has 2 no criminal antecedent as has been stated in para 17 of the present anticipatory bail application. The petitioner, however, undertakes to co- operate in the investigation. Hence, he may be given the privilege of anticipatory bail. 3. Learned A.P.P. opposes the petitioner’s prayer for grant of anticipatory bail. 4. Having heard learned counsel for the parties and considering the material available on record, I am inclined to enlarge the petitioner on anticipatory bail. 5. Accordingly, the petitioner, above named, in the event of his arrest or surrender before the court below within three weeks from today, shall be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Chatra in connection with Pratappur P.S. Case No. 06 of 2025, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Rajesh Shankar, J.) P.K.S.
