The authorized representative of Bajaj Allianz Company is identified by Sri Aditya Singh Parihar, Advocate, is present and has submitted an application requesting for dismissal of appeal as withdrawn/not pressed. The contents of application read as under:- “1. This appeal was instituted on certain arguable issues but during pendency but during pendency, since there was no interim order in favour of the Insurance Co./Appellant, the entire awarded amount has been recovered from the Insurance Co./Appellant during the execution proceedings drawn by the Claimant(s). 2. In the light of the above, the Insurance Co./Appellant has decided to not press the present appeal 3. Amount deposited at the time of filing of appeal be remitted to the Tribunal below and may be allowed to be withdrawn by the Appellant/Insurance Co. 4. It is respectfully prayed that the appeal may be dismissed as withdrawn/not pressed. 5. This withdrawal shall not affect right of the appellant to contest in any other appeal/cross appeal/cross objection arising out of the same issue/accident. ” 3.
