Heard learned counsel for petitioner and learned State Counsel for opposite parties. Petition has been filed seeking a direction to concerned authority for considering his prayer for grant of benefits of old pension scheme in terms of the government order dated 28th June, 2024 and 11th July, 2024. However it appears from record that petitioner's application for grant of such benefit has been returned vide order dated 23rd May, 2025 on the ground that it is beyond the cut off date provided in paragraph 5(1) of the government order dated 28th June, 2024. It is also evident that the aforesaid cut off date has not been challenged in the present writ petition. In view thereof, learned counsel for petitioner on the basis of instructions seeks to withdraw this petition with liberty to file afresh challenging the said petition. Considering aforesaid, the petition is dismissed as withdrawn granting liberty to file afresh in order to effect challenge to the cut off date.
