ORDER:
The instant Criminal Petition under Section 482 of Cr.P.C has been filed by the Petitioner/Accused, seeking to quash the proceedings against him in C.C.No.112 of 2020 on the file of the Court of Judicial First Class Magistrate, Railway Kodur, YSR Kadapa District for the offences under Sections 354 and 506 IPC.

Sri Suresh Kumar Reddy Kalava, learned counsel for the Petitioner would submit that, after lodging a case for the offence under Section 498-A IPC against the Petitioner, who is the husband of Respondent No.1, the present case has been lodged against the Petitioner. Learned counsel would further submit that, it is alleged against the Petitioner that, when Respondent No.1 entered his house to collect her certificates and other belongings, the Petitioner dragged her outside by catching her tuft of hair, beat and intimidated her. It is submitted that, recently the Petitioner filed H.M.O.P.No.125 of 2021 on the file of the Court of Principal Senior Civil Judge, Tirupati for the dissolution of the marriage between him and Respondent No.1 herein and the said petition was allowed on 16.06.2023.
Learned counsel would further submit that, the case against the Petitioner for the offence under Section 498-A IPC is pending before the Court. It is further submitted that the neighbours of the locality did not say about the alleged incident. Learned counsel would finally pray for quashment of the case.
3. Learned Assistant Public Prosecutor would submit that there are clear allegations made against the Petitioner to attract the offences alleged against him. This is not a fit case for quashment. Hence, prayed for dismissal of the petition.
4. Considering the submissions made and a fair look at the material placed on record, as rightly put by the learned Assistant Public Prosecutor, there is verifiable material, which requires elaborate enquiry. In that view,

quashment of the case against the Petitioner, at this stage, does not arise. Petition is devoid of merits and the same is liable to be dismissed.
5. In the result, the Criminal Petition is dismissed. Pending applications, if any, shall stand closed.
