The present application under Section 438 Cr.P.C./482 B.N.S.S. has been filed seeking anticipatory bail in FIR/Case Crime No. 231 of 2024, under Sections 191(2), 191(3), 190, 115(2), 352, 351(2), 351(3), 288, 109, 110 of B.N.S., P.S. Baghrai, District Pratapgarh. In the prosecution case, it is alleged that the applicant along with the co-accused with a common intent armed with deadly weapons have beaten the complainant and his friend Gaurav Pandey with lathi-danda as well as with the butt of a countrymade pistol. Learned counsel for the applicant submits that the applicant is innocent and he has been falsely implicated in the present case. Learned A.G.A. has opposed the anticipatory bail application. Perused the record. A perusal of the record shows that there are two injured persons. The first injured Shakti Singh has received three injuries, out of which injury No. 1 is a lacerated wound on left parietal region. The second injured Gaurav Pandey has received six injuries, out of which four injuries are lacerated wounds on occipital and parietal region. The applicant is named in the FIR. The injured have also named the applicant and supported the prosecution case. Hence, it cannot be said that the applicant has been falsely implicated in the case. In view of the above, no ground for grant of anticipatory bail is made out. Accordingly, the anticipatory bail application is rejected.
