The present application has been led for condonation of delay in ling the present appeal. It has been averred in the application that the copy of the impugned judgment was applied by the learned counsel for the applicant on 12.12.2024 and the same was delivered on 08.01.2025. It has been further contended by the learned counsel for the applicant that when the copy of the judgment was supplied to the o'ce of the applicant then prompt action was taken for engaging the counsel for ling an appeal. It has been also contended that the delay in ling the appeal is neither intentional nor willful and the same has occurred due to unavoidable circumstances, which were beyond the control of the applicant. Keeping in view the averments as made in the application, which is duly supported by an a'davit and keeping in view the fact that the learned counsel for the respondents have no objection in case delay is condoned, the present application is allowed and the delay of 413 days in ling the present appeal is condoned.
