Neutral Citation No. - 2025:AHC-LKO:42565-DB Chief Justice's Court Case :- SPECIAL APPEAL DEFECTIVE No. - 306 of 2025 Appellant :- Dr. A.P.J. Abdul Kalam Technical Univerisity Lko. through its Registrar and another Respondent :- C/M S.G.M. Institute of Pharmacy through its Dir. Shri Alok Kumar Trivedi and 2 others Counsel for Appellant :- Atul Kumar Dwivedi Counsel for Respondent :- C.S.C., V.P. Nag (S.C.), Rajat Rajan Singh, Ravi Singh Hon'ble Arun Bhansali,Chief Justice Hon'ble Jaspreet Singh,J. 1. This appeal is directed against the order dated 19.05.2025 passed by learned Single Judge, whereby the writ Court has given a direction as an interim measure to permit the students studying in the respondent's institution to undertake their examination of first year B.Pharma Course 'subject to final orders'. 2. Examinations were scheduled from 20.05.2025 i.e. from the next day, on which the order was passed by the learned Single Judge. 3. The present appeal has been filed on 16.07.2025 and is barred by 15 days. 3. Counsel for the appellants submits that despite the interim directions given by learned Single Judge, on account of the legal impediment, the students could not be permitted to undertake their examination of the first year B.Pharma Course. Further submissions have been made that application seeking vacation of the order dated 19.05.2025 along with counter affidavit to the petition has already been filed, which is pending consideration before the learned Single Judge. 4. In the circumstances of the case, wherein interim order, which is sought to be challenged by the petitioner in the present appeal, has not been complied with, may be for the purported legal impediment and the application seeking vacation of the order dated 19.05.2025 is pending, we do not find any reason to entertain the present Special Appeal qua interim order passed. The same is, therefore, disposed of, leaving it open to the appellants to contest the matter before the learned Single Judge, including the application seeking vacation of the order dated 19.05.2025.
