Petitioner is serving as Tax and Revenue Inspector in Palika Central Service. She was transferred from Municipal Corporation, Rudrapur (Udham Singh Nagar) to Municipal Corporation, Srinagar (Pauri Garhwal) vide order dated 28.02.2024. Thus feeling aggrieved by her transfer, petitioner approached this Court. 3. Learned State Counsel submits that petitioner was appointed as Tax and Revenue Inspector in 2015 and ever since her appointment, she was posted at Rudrapur, District Udham Singh Nagar. Thus he submits that petitioner’s transfer was as per the transfer policy. 4. Learned counsel for petitioner, however, submits that there is element of malice involved in petitioner’s transfer, as the then Deputy Municipal Commissioner was inimical towards petitioner, who was instrumental in getting her transferred out of Rudrapur. 2025:UHC:10877 5. Since petitioner holds a transferable post, therefore, this Court is not inclined to interfere with the order of transfer passed in respect of petitioner. However, having regard to the facts and circumstances of the case, writ petition is disposed of with liberty to petitioner to make representation regarding her transfer to the Director, Urban Development. 6. If she makes such representation within two weeks from today, Director shall look into the matter and pass appropriate order as per law, within six weeks thereafter. 7. For a period of eight weeks, or till decision is taken on petitioner’s representation, whichever is earlier, status quo as regards petitioner’s posting shall be maintained.
