(2) According to petitioner, Village Mohammadpur Bujurg, Tehsil Roorkee, District Haridwar came under consolidation operation in 2005 and the consolidation proceedings are still on, however huge tract of public utility land within the village has been encroached upon by the unscrupulous persons, which is causing problems for the residents of the village. By means of this writ petition, petitioner has sought a direction to the authorities to conduct fresh measurement and demarcation of chak in accordance with the consolidation scheme. (3) Learned State Counsel submits that if petitioner has any grievance, then he should have approached the Settlement Officer, Consolidation, instead of rushing to this Court. (4) Learned Counsel for the petitioner submits that petitioner be permitted to make representation to the Settlement Officer, Consolidation. (5) Writ petition is, accordingly, disposed of with liberty to the petitioner to make representation to Settlement Officer, Consolidation within three weeks from today. If he makes representation within the stipulated time, Settlement Officer, Consolidation shall make endeavour to take decision on the same within one year 2025:UHC:9625 thereafter. It goes without saying that the persons, who are likely to be affected by the decision to be taken by Settlement Officer, Consolidation, shall also be given opportunity of hearing before passing any order.
