1. These bail applications have been filed under Section 483 of B.N.S.S. on behalf of the accused-petitioners, who have been arrested in connection with FIR No.51/2025 registered at Police Station Manoharpur, District Jaipur Rural for the offence punishable under Sections 8 and 21 of the NDPS Act, 1985.
[2025:RJ-JP:21223] (2 of 3) [CRLMB-5035/2025]
2.
Learned counsel for the petitioners submit that the petitioners have falsely been implicated in this case and alleged recovered contraband is below commercial quantity; charge-sheet has already been filed and petitioners are in custody since 03.03.2025; the trial of the case will take considerable time, therefore, further custody of the petitioners would not serve any fruitful purpose and petitioners be released on bail.
3. Learned Deputy Government Advocate has opposed the
submissions made by the learned counsel for the petitioners.
4. Heard learned counsel for both the parties and perused the material available on record.
5. Having regard to the totality of the facts and circumstances of the case, considering the arguments so advanced by the
learned counsel for the petitioners, as also the fact that the alleged contraband is below commercial quantity; charge-sheet has already been filed, considering the fact that accused- petitioners are in judicial custody since 03.03.2025 and the fact that the matter is exclusively triable by Magistrate and trial/investigation of the case may take considerable time, thus, without commenting any opinion on the merits/demerits of the case, I deem it just and proper to allow these bail applications.
6. Accordingly, these bail applications under Section 483 B.N.S.S. are allowed and it is ordered that the accused-petitioners Mukesh Singh S/o Mahaveer Singh and Yogesh Singh Shekhawat S/o Shri Ramsingh Shekhawat in connection with FIR No. 51/2025 registered at Police Station Manoharpur, District Jaipur Rural shall be enlarged on bail provided each of them
[2025:RJ-JP:21223] (3 of 3) [CRLMB-5035/2025] furnishes a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each together with two sureties in the sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each to the satisfaction of the learned Trial Court for their appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
7. It is made clear that the accused-petitioners shall not involve in any other offence(s) during currency of the bail and they shall mark their presence in the first week of every two months in concerned policy station.
8. If any breach of these considerations is reported or come to the notice of the Court, the same shall alone be a reason for the trial Court to cancel the bail granted to him by this Court.
9. Concerned SHO is directed to maintain a register recording the attendance of the petitioner. In case the petitioners fails to mark their presence in the concerned police station, the concerned SHO is directed to immediately report the matter to the concerned Court in this regard.
