The petitioner is challenging the action of the 2nd respondent in cancelling the auction proceedings dated 03.07.2008 vide RC.No.C3/459/M/2008, dated 10.07.2008. The petitioner is seeking a consequential direction to cancel the cancellation proceedings and to release the goods which were purchased by the petitioner in the public auction. 2. Learned counsel for the petitioner submits that the petitioner participated in the auction and purchased the weapons which were put to auction by the respondents. It is submitted that though the petitioner was a successful bidder and remitted an amount of Rs.62,710/-, the respondent authorities have not handed over the auction weapons. 3. Learned Government Pleader appearing for the 3rd respondent submits that the auction was cancelled vide orders dated 21.07.2008 as the government received a representation from Arms Dealers Association of Andhra Pradesh that the petitioner played some mischief in the auction and as such after verification, the auction was cancelled. 4. It is also submitted that the petitioner filed WP.No.31450 of 2013 seeking possession of the Arms which were put to auction. Learned -3- single judge of this Court dismissed the writ petition duly considered the submissions of the respondent authorities that the auction was conducted, the initial auction was cancelled and re- auction was conducted. 5. Heard the learned counsel for the petitioner, learned Government Pleader for the 3rd respondent. Perused the material on record. 6. The petitioner is seeking to set aside the cancellation of auction proceedings and seeking a direction to deliver the goods which were put to auction on 03.07.2008, this relief cannot be granted in favour of petitioner as the respondent authority have taken a decision to cancel the auction proceedings on 21.07.2008 and the District Collector had conducted re-auction. 7. When the subject property of the auction is not in possession of the respondents and when the same is passed on to the new successful bidder, no purpose can be served in entertaining this writ petition any further. 8. Accordingly, the writ petition is dismissed.
