The present appeal is filed by the appellant- Shri Ashutosh Yadav, S/o Shri Ferai Yadav, R/o Ashraf Nagar, Bijnor, District- Lucknow along with the application for condonation of delay and the affidavit in support of delay condoantion application has been sworn by Shri Ram Yadav, C/o Shri Pherai Yadav R/o Ashraf Nagar, Bijnor, District- Lucknow (brother of the appellant) But neither any power of attorney nor any authority letter has been filed in favour of the deponent. 2. At this stage, learned counsel for the applicant submits that he does not want to press the present application and prays for withdrawal of the same with liberty to file afresh. 3. The prayer made is allowed. 4. Accordingly, the application is dismissed as withdrawn with the aforesaid liberty. 5.
