Neutral Citation No. - 2025:AHC-LKO:41655 Court No. - 14 Case :- CRIMINAL MISC. BAIL APPLICATION No. - 6665 of 2025 Applicant :- Lalit Kumar Diwedi @ Rahul Opposite Party :- State Of U.P. Thru. Prin. Secy. Home Lko. Counsel for Applicant :- Bharat Kumar Dixit Counsel for Opposite Party :- G.A. Hon'ble Karunesh Singh Pawar,J. Heard learned counsel for the applicant, learned AGA for the State and perused the record. In the prosecution case, it is alleged that 10 kilograms of ganja were recovered from a Scorpio car occupied by three accused individuals. It is further alleged that the applicant fled from the spot. Learned counsel for the applicant submits that the applicant was not apprehended at the spot. He submits that co-accused Mukeesh, from whom 3.450 kilograms of ganja was allegedly recovered, has already been granted bail by this Court vide order dated 11.07.2025 in Criminal Misc. Bail Application No. 6414 of 2025. The applicant seeks parity with co-accused Mukeesh. It is further submitted that no recovery has been made from the applicant, and he has explained his criminal antecedents in paragraph 13 of the bail application. The applicant is languishing in jail since 17.06.2025. It is further submitted that there is no possibility of the applicant of fleeing away after being released from jail or tampering with the witnesses. In case the applicant is enlarged on bail, he shall not misuse the liberty of bail. Learned A.G.A. opposed the prayer for bail but could not dispute the aforesaid facts as argued by the learned counsel for the applicant. On due consideration to the fact that co-accused Mukeesh, from whom 3.450 kg of ganja was recovered, has already been granted bail; no recovery has been made from the present applicant; he is in custody since 17.06.2025; and his criminal antecedents have been explained in paragraph 13 of the bail application, I am of the view that the applicant deserves to be enlarged on bail. Accordingly, the bail application is allowed. Let the applicant Lalit Kumar Diwedi @ Rahul involved in Case Crime No.83 of 2025, under Sections 8/20 of NDPS Act and Section 3/25 Arms Act, P.S. (iv) The applicant shall file an undertaking to the effect that he shall not seek any adjournment on the dates fixed for evidence when the witnesses are present in court. In case of default of this condition, it shall be open for the trial court to treat it as abuse of liberty of bail and pass orders in accordance with law. (v) The applicant shall remain present before the trial court on each date fixed, either personally or through his counsel. In case of his absence, without sufficient cause, the trial court may proceed against him in accordance with law.
