Satyen Vaidya, Judge (Oral) The parties were referred to the mediation. The learned Mediator has reported that the mediation has been successful. The parties have entered into an amicable settlement, the terms of which have been recorded by the learned Mediator on 27.5.2025 in the presence of the parties as also their respective counsel. The parties and the counsel have acknowledged the terms of settlement by signing the record thereof. In terms of such settlement, the parties have decided to get the Civil Suit No. 198 of 1 Whether reporters of Local Papers may be allowed to see the judgment? -2- 2023, pending on the files of learned Civil Judge, Manali, District Kullu, H.P. decreed in terms of the settlement. 2. Accordingly, this petition has been rendered infructuous and is disposed of accordingly along with pending applications, if any. Civil Suit No. 198 of 2023 pending on the files of learned Civil Judge, Manali, District Kullu, H.P. Since the parties have settled the subject matter of the suit by mutual settlement, the terms of which have been recorded by the learned Mediator Sh. N. K. Sood, Senior Advocate on 27.5.2025 during the mediation proceedings, a joint prayer has been made for decreeing the above noted suit in terms thereof. Accordingly, Civil Suit No. 198 of 2023 is withdrawn from the file of learned Civil Judge, Manali, District Kullu to the files of this Court. 2. The statements of the parties have been recorded today in the Court. They have acknowledged the factum of compromise having been arrived at between them. They have further acknowledged the terms and conditions of the settlement recorded by the learned -3- Mediator and have identified their respective signatures thereon. 3. I have gone through the terms of the settlement. I am satisfied that none of the terms violate any law. The settlement thus can be acted upon legally. 4. Accordingly, Civil Suit No. 198 of 2023, titled as, Vibhuti Katyayen vs. Ajay Kumar & others, withdrawn from the files of learned Civil Judge, Manali, District Kullu, H.P. is disposed of and decreed in terms of the settlement recorded by the learned Mediator on 27.5.2025. The terms of the settlement along with spot report dated 7.4.2025, prepared by Tehsildar, Manali, District Kullu and the record annexed therewith, including the statements of the parties, copy of jamabandi and tatima shall form part of the decree. 5. Decree sheet be prepared accordingly. 6. The original of the terms of settlement recorded by the learned Mediator on 27.5.2025 along with original of the spot report, prepared by Tehsildar, Manali, District Kullu along with original documents annexed with the said report shall be placed in the file of Civil Suit and a copy -4- thereof be retained in the records of learned Mediator.
