Neutral Citation No. - 2025:AHC-LKO:41698 Court No. - 14 Case :- CRIMINAL MISC ANTICIPATORY BAIL APPLICATION U/S 438 CR.P.C. No. - 795 of 2025 Applicant :- Arvind Kumar Singh Opposite Party :- State Of U.P. Thru. The Prin. Secy. Home Deptt. Lko. And Another Counsel for Applicant :- Anjali Dubey,Soniya Mishra Soni Pathak Counsel for Opposite Party :- G.A. Hon'ble Karunesh Singh Pawar,J. The present anticipatory bail application has been filed seeking anticipatory bail in F.I.R./Case Crime No.426 of 2019 Under Sections-419,420,467,468,471 I.P.C., Police Station- Kotwali, District- Unnao. Heard learned counsel the applicant and learned A.G.A. for the State. Notice to respondent no. 2 is dispensed with in view of the proposed order. Learned counsel for the applicant submits that the applicant is neither the seller, nor the purchaser, nor a witness to the said sale deed. It is further submitted that the alleged amount was transferred into the applicant's bank account. The offences involved are triable by a Magistrate. The applicant undertakes to cooperate with the investigation and has no prior criminal history. On the other hand, learned AGA has opposed the anticipatory bail application, stating that the named accused persons, in collusion with the managerial staff, namely Devendra Singh Bahdoriya, Purnima Singh, and Nitin Kumar, have misappropriated public funds. It is pointed out that a sum of Rs. 36,00,000/- was transferred into the applicant's account by co- accused Santosh Kumar Shukla, indicating the applicant’s involvement. Custodial interrogation is stated to be necessary in the matter. Having considered the submissions made and the fact that Rs.36,00,000/- was credited to the applicant’s account from that of a co-accused, it cannot be held that the applicant has been falsely implicated or named merely to tarnish his reputation. The offence is punishable with life imprisonment. No ground for grant of anticipatory bail is made out. The bail application is accordingly dismissed. Order Date :- 22.7.2025 R.C.
