The petitioner claims to be a patta holder of land bearing Gata No. 237 situated at Village Besana, Bhairopur, Pargana Aldemau, Tesil Kadipur, district Sultanpur which has been encroached by the private opposite parties. However, learned standing counsel says that the land is recorded as navin parti and the proceedings for removal of encroachment have been initiated under Section 67 of the U.P. If the petitioner is able to satisfy the Sub Divisional Magistrate, Kadipur, Sultanpur that he is patta holder, he may get the facts verified and if he finds it it to be so, then, he will have to take remedial measures as may be permissible in law as long as the patta exists in favour of the petitioner and there is no other legal impediment, but, after hearing the alleged encroachers. Let the aforesaid exercise, if required, be completed within two months from the date of receipt of a certified copy of this order. 4. The writ petition is disposed of accordingly.
