Neutral Citation No. - 2025:AHC-LKO:42516 Court No. - 18 Case :- WRIT - A No. - 7889 of 2025 Petitioner :- Smt. Sangeeta Singh Respondent :- State Of U.P. Thru. Addl. Chief Secy. Bal Vikas Seva Evam Pustahar Vibhag Lko. And 8 Others Counsel for Petitioner :- Shailendra Kumar Tiwari,Sunny Sharma Counsel for Respondent :- C.S.C. Hon'ble Manish Mathur,J.
1. Heard learned counsel for petitioner and learned State Counsel for opposite parties no. 1 to 8 while power on behalf of opposite party no. 9 has been filed by Mr. Tauqueer Alam, Mr. Kaushal Kumar and Mr. Sanjeet Kumar, which is taken on record.
2. Petition has been filed challenging order dated 02.06.2025 whereby petitioner's selection and appointment on the post of Aganwadi Worker in the center concerned has been cancelled on the basis of a complaint which was made by opposite party no.9, Mohini Singh daughter of Sri Vikram Singh.
3. From a bare perusal of the impugned order, it is evident that it has been passed primarily on the basis of complaint made against petitioner and a preliminary inquiry report which was submitted in pursuance of the complaint. It is ex-facie evident that the impugned order does not indicate any notice having been issued to petitioner or any opportunity of hearing being provided to her. It is also evident that after selection of petitioner had been issued appointment letter and had joined in pursuance thereof and therefore, has a vested right for being heard prior to passing of any adverse order. Such a course of action having not been followed, renders the impugned order vitiated.
4. In view thereof, the impugned order dated 02.06.2025 is hereby quashed by issuance of a writ in the nature of certiorari granting liberty to opposite parties to pass orders afresh but only after affording opportunity of hearing to petitioner and considering her reply.
5. Resultantly, the petition succeeds and is allowed. Parties to bear their own cost.
