This appeal is directed against the order dated 26.04.2025 passed by the learned Additional Sessions Judge-IX, Giridih in B.P. No. 216/2025, arising out of Jamua P.S. Case No. 38/2025, whereby and whereunder, the prayer for bail of the appellant has been rejected. It has been alleged that the appellant as well as some other named accused persons were trafficking the women of the rural areas who are working in Banvasi Vikas Ashram Sanstha Giridih to Rajasthan for the purposes of prostitution. Submission has been advanced by the learned counsel for the appellant that one of the victims Bhuti Devi has already been recovered. It has been submitted that the appellant is in custody since 26.02.2025 and one of the co- accused Binod Prasad Yadav @ Binod Kumar Yadav has been granted bail by a coordinate Bench of this Court in Criminal Appeal (D.B.) No. 551 of 2025. Mr. Manoj Kr. Mishra, learned A.P.P. has opposed the prayer for bail of the appellant and has submitted that the case of the appellant stands on a Neutral Citation No. ( 2025:JHHC:15954-DB ) -2- different footing to that of the co-accused who has been granted bail by this Court. Considering the fact that one of the victims has already been recovered and the period of custody undergone by the appellant, we while setting aside the order dated 26.04.2025 passed by the learned Additional Sessions Judge-IX, Giridih in B.P. No. 216/2025, arising out of Jamua P.S. Case No. 38/2025, direct that the appellant be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate First Class, Giridih in connection with Jamua P.S.
