Heard learned counsel for the parties.
2. The instant bail application has been preferred by the petitioner for grant of regular bail for the offences registered under Sections 319(2), 318(4), 338, 336(3), 340(2) & 61 of the Bharatiya Nyaya Sanhita, 2023 read with Section 66 (B), 66(C) & 66 D, 84 (C)) of the I.T. Act.

Learned counsel for the petitioner submits that the petitioner is innocent person and has been falsely and maliciously implicated in the instant case. He further submits that nothing incriminating has been seized from the conscious possession of the petitioner showing his involvement in cybercrime. He further submits that the petitioner is in custody since 21.09.2024. Further, the charge has been framed against the above petitioner and till date not a single witness has been examined and petitioner is having no criminal antecedent.
4. Learned Spl.P.P. opposes the prayer for bail of the petitioner.
5. Having regard to the facts of the case and looking to the allegation made against this petitioner couple with the fact that petitioner is having no criminal antecedent and charge has already been framed; I am inclined to

enlarge this petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II cum Special Judge, Cyber Crime, Deoghar, in connection with Deoghar (Cyber), P.S. case No. 98 of 2024.
6. It is made clear that the petitioner shall appear on each and every date before the learned trial court and shall not threaten any of the witnesses; failing which, the learned trial Court shall be at liberty to cancel his bail.
