GP FOR COOPERATION 2 The Court made the following Order: This Writ Petition is filed, under Article 226 of the Constitution of India, seeking the following relief: “…. to issue an appropriate writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the of the 2nd respondent in filling up the vacant posts arose in the Category of Assistant Manager by applying the Rule of Reservation and thereby promoting the Respondents 4 to 9 without considering the petitioners herein who are seniors in the Final Seniority list dated 27.09.2018 is illegal, arbitrary, high handed, violative of principles of natural justice and violation of Articles 14 and 21 of Constitution of India the and also contrary to the Service Regulations of the 2nd Respondent Bank and consequently direct the 2nd Respondents to follow the Final Seniority List dt.27.09.2018, prepared in the cadre of Staff Assistant for effecting promotions to fill up the vacant posts in the Category of Assistant Managers in 2nd respondent Bank subject to result of W.P.No.37537 of 2018….” 2. On an earlier occasion i.e., on 22.01.2025, learned counsel for the petitioners submits that he has given no objection vakalat to the petitioners two months ago. 3. Today, when the matter is none appeared for the petitioners. 4. Learned Assistant Government Pleader for Cooperation, for the respondent(s) is present. 5. Upon perusal of the material on record, this writ petition is filed in the year 2020. After a lapse of 4 years, even the learned counsel for the petitioners on record has given No-Objection Vakalat to the petitioner, till date the petitioners have not taken any steps either to engage a new counsel or to 3 appear in person to prosecute the case. It seems that the petitioners are not interested in prosecuting the case. 6. Therefore, the Writ Petition is dismissed for non-prosecution. There shall be no order as to costs.
