The earlier recovery proceedings against the petitioner were subject matter of challenge in a writ petition bearing No. 7356 (M/B) of 2012 wherein an interim order was passed on 03.09.2012, but subsequently, i.e. on 24.01.2013, the petition came to be dismissed for want of prosecution. Consequently, another recovery citation to the tune of Rs. 5,18,820/- has been issued to the petitioner for recovery of electricity dues. The petitioner’s Counsel says that the electricity connection has been permanently disconnected in 1994. The remedy for the petitioner is to move a recall application in the earlier writ petition, if otherwise permissible. Second writ petition will not lie on the same facts in view of Chapter XXII Rule 7 of the Allahabad High Court Rules, 1953. The writ petition is accordingly disposed of.
