Mr. Piyush Garg, learned counsel for the applicant in BA1 No. 677 of 2025. 2. Mr. Susheel Kumar, learned counsel holding the brief of Mr. Gaurav Singh, learned counsel for the applicant in BA1 No. 903 of 2025. 3. Mr. Himanshu Sain, learned Brief Holder for the State. 4. Present applicants Vineet Verma, S/o Gangaprasad and Vaibhav Pant, S/o Ramesh Pant are praying for bail in reference to FIR dated 07.11.2024, bearing FIR/Case Crime No. 0879 of 2024 registered at P.S. Kotwali Haridwar, District Haridwar wherein the present applicants have been implicated for the offences punishable under Sections 323, 376, 384, 504 and 506 IPC along with other co- accused, Priyanshu and Gautam @ Ilu. 4. It is argued by the learned counsels for the applicant that both the applicants are innocent and, in fact, the victim was in love with the co-accused Gautam @ Ilu. He further submits that there are serious contradictions on the statement of the victim recorded under Section 183 of BNS 2023, and furthermore charge sheet has already been filed, and, as such, there is no need of custodial interrogation of the applicants and the applicants are languishing in jail since 09.11.2024. He further argued that one another co- accused, namely, Krish Thakur @ Priyanshu has already been enlarged on bail. Apart from this, he submits that the applicants are young persons, having no nexus with the incident, as alleged, and there is no evidence against the present 2025:UHC:9661 applicant and claims parity of co-accused Krish Thakur @ Priyanshu . 5. On the other side, Mr. Sain, learned Brief Holder for the State has not disputed this fact that the case of both the applicants are identical to co-accused Krish Thakur @ Priyanshu who has been granted bail and the main allegation is against the co-accused Gautam @ Ilu. He has also not disputed that the charge sheet has already been filed, and, as such, there is no need of custodial interrogation. Apart from this, he fairly submits that both the applicants deserve benefit of parity of co-accused Krish Thakur @ Priyanshu. 6. After hearing the arguments of the learned counsel for the parties and taking into consideration that other co-accused has already been granted bail and furthermore, charge sheet has already been filed, and both the applicants are languishing in jail since 09.11.2024, this Court is of the view that the present applicant deserves for bail. 7. Accordingly, without expressing any opinion on the merit of the case, both the bail applications are allowed. 8. Let the applicants Vineet Verma and Vaibhav Pant be released on bail on their executing a personal bond and furnishing two reliable sureties, by each one of them of the like amount to the satisfaction of the court concerned.
