Heard learned counsel for the petitioner and learned A.G.A. appearing for the State. 2. This writ petition has been filed with the following prayers:- "i. Issue a writ, order or direction in the nature of certiorari thereby quashing the impugned First Information Report dated 09.04.2019 at 02:52 hours registered as F.I.R./ Case Crime No. 0060 of 2019, Under sections-3/5/8 of the U.P. Prevention of Cow Slaughter Act, 1955 & section-11 of the Prevention of Cruelty of Animals Act, 1960 & section-420 of I.P.C. Police Station-Aaspur Deosara, District-Pratapgarh lodged by opposite party no.4 against Irshad and 2 others and Track driver as contained in Annexure No.1 to this writ petition. ii. A writ order or direction in the nature of mandamus commanding the opposite parties not to harass or arrest the petitioner in terms of impugned First Information Report." 3. It has been submitted by the learned counsel for the petitioner that the petitioner has falsely been implicated in the present case and initially F.I.R. did not disclose the name of the petitioner. 4. Learned A.G.A. has produced before this Court instructions sent by Sub Inspector, Police Station-Aaspur Deosara, District- Pratapgarh wherein it has been stated that F.I.R. was lodged way back in 2019. During the course of the investigation owner of the truck Sahabuddin was tried to be contacted but he has left his original place of residence and started living in Lucknow. Charge Sheet No. 97/19 has prepared against Irshad S/o Late Wajeer and Kallu Raidas S/0 Murli Raidas and the same has been submitted in Court. Investigation against the petitioner is pending. The instructions are kept on record. 5. Since the petitioner is reported to be absconder for the past six years, we do not wish to interfere in the impugned F.I.R at this stage. 6. The writ petition is accordingly dismissed.
