Heard learned counsel for petitioner and learned State Counsel for opposite parties. 2. Petition has been filed seeking a direction to concerned authority to consider petitioner's promotion on the post of Head Constable and Sub-Inspector (Civil Police) from the date such benefit was granted to persons junior to petitioner. Consequential several benefits have also been sought. 3. It is submitted that petitioner's recommendation by the Departmental Promotion Committee was kept under sealed cover in the year 2006 due to pendency of criminal case. He, therefore, submits that petitioner's case is covered by judgment rendered by Hon'ble Supreme Court in the case of Union of India versus K.V. Janki Raman, AIR 1991 SC 2010 as well as by the subsequent Government Order dated 28.05.1997. 4. Since consideration of petitioner's grievance would entail factual aspects and a representation has already been submitted by petitioner dated 25.04.2025, opposite party no. 2 i.e. Additional Director General of Police (Etablishment) U.P. Police Headquarter, Lucknow is directed to consider and decide the representation in the light of aforesaid judgment and Government Order within a period of six weeks from the date a certified copy of this order is produced before the said authority. Petitioner shall annex copies of representation dated 25.04.2025, the judgment and Government Order indicated hereinabove alongwith a certified copy of this order. 5. With aforesaid directions, petition stands disposed of.
