The petitioner wants disposal of his mutation application, whereas learned Counsel for the Nagar Panchayat says that there is already a civil suit pending wherein the petitioner has filed an application for impleadment. Per contra, learned Counsel for the petitioner says that the said application has been rejected and an appeal is pending. Let the petitioner verify the facts as regards pendency of the civil suit and then apprise the Executive Officer, Nagar Panchayat, Kakori, Lucknow as to the factual position, whereupon the said Officer may take a decision on the application of the petitioner in the context of the pending mutation application as to whether it is liable to be decided or not. Let this be done within a period of six weeks. The writ petition is accordingly disposed of.
