The applicant has preferred this first application under Section 483 of Bhartiya Nagarik Suraksha Sanhita, 2023, for grant of regular bail in connection with Crime No.155/2025, registered at Police Chowki- Belgahna, Police Station- Kota, District Bilaspur, C.G. for the offence punishable under Sections 34(2), 34(1)(kha) of the Excise Act. 3. The case diary was perused in the context of the above application which shows that on 21.02.2025, 10 liters of hand- VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2025.04.21 12:23:01 +0530 2 made Mahua (liquor) filled in 10 liters plastic jerrycan was recovered from the possession of the applicant near Jaitkham in Village Karwa, which he kept for selling. 4. Furthermore, pursuant to the direction of this Court dated 28.03.2025, it has been informed by learned State counsel that the applicant herein is an habitual offender and as many as 05 other cases have also been registered against him, therefore, the applicant is not liable to be granted regular bail by this Court. 5. Considering the nature and gravity of the offence and material on record in the case diary and also considering the fact that the applicant is an habitual offender and 05 other cases have also been registered against him, I am not inclined to grant regular bail to the applicant.
