Heard Shri Zubair Hasan, learned counsel for the petitioner as well as learned Standing Counsel for the State respondents. 2. In light of the proposed order, notice to private respondents is hereby dispensed with. 3. Instant petition has been filed by the petitioner for a direction to respondents to remove illegal encroachments over the Gata No.185/0.0250 situated at Village Tarauna, Pargana and Tehsil Malihabad, District Lucknow and also to take action under Section 67(1) of U.P. Revenue Code, 2006 against the respondents no.5 and 5. 4. It has been submitted by the counsel for the petitioner that the private respondents are encroaching upon Gata No.185/0.0250 situated at Village Tarauna, Pargana and Tehsil Malihabad, District Lucknow and despite various representations and applications given to the competent authority, no action has been taken. In the aforesaid circumstances, he prayed for a direction to the respondents to proceed and conclude the proceeding under Section 67(1) of the U.P. Revenue Code, 2006 expeditiously. 5. Learned Standing Counsel has no objection to the aforesaid prayer. 6. Accordingly, the petition is disposed of with liberty to the petitioner to move an appropriate application under Section 67(1) of the U.P. Revenue Code before the competent authority, who is further directed to consider and decide the application with expedition in accordance with law.
