Heard the learned counsel for the petitioners and the learned Assistant Public Prosecutor appearing for the State. 2. The learned counsel for the petitioner submits that the petitioner was arraigned as accused in Crime No.323 of 2024 of Cyber Crime Police Station, Visakhapatnam, registered for the alleged offence under Sections 78, 361(2) read with 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Sections 66-D and 67 of the Information Technology Act, 2000-2008. 3. It is submitted that the complaint filed against the petitioner is a counter blast to the complaint filed by the petitioner and that the petitioner has lent certain amount to the 2nd respondent and that the when the petitioner demanded the payment of the said amount, the 2nd respondent has filed false complaint. 4. Be that as it may, the petitioner was already issued served with a notice under Section 41A of Cr.P.C. by the police and is cooperating with the police for investigation. 5. Considering the nature of allegations and considering the stage of investigation, this Court is not inclined to interfere with the proceedings at this stage. 3 CRL.P. No.4132 OF 2025 6.
