The impugned communication is pursuant to a representation of the petitioner dated 11.12.2024 for no objection for registering the property, which was purchased by the petitioner on 09.01.2017 from Anandha Samuthiram Grama Bhramana Samuthaya Vagai. It is the case of the petitioner that the Trust was formed by Brahmins of Anandha Samuthira Gramam Village in Nagercoil and the Trust owns about 11 acres of cultivable land in Survey No.499 of Thalakudi Village, Thovalai Taluk, Kanyakumari District and that pursuant to a resolution passed by the Board of Trustees to alienate the said land as the revenue generated from the said lands were meager, a land to an extent of 3 Acres and 95 Cents in Thalakudi Village, Thovalai Taluk, Kanyakumari District was alienated by the Managing Trustee, namely, P.Dharmarajan in favour of the petitioner on 09.01.2017 vide Document No.29/2017 on the file of the Sub Registrar, Boothapandi, the fourth respondent herein. Since the impugned order mandates that the petitioner shall not alienate or encumber the property, the petitioner is before this Court. The issue is now squarely covered in terms of the decision of the Division Bench of this Court in the case of Sudha Ravi Kumar and another Vs. The Special Commissioner and Commissioner, Hindu Religious and Charitable Endowments Department, Chennai and others reported in (2017) 3 CTC 135, wherein, sub paragraph (iv) of paragraph 26 makes it clear that under the present circumstances, the petitioner or the intending buyer, who proposes to buy the property from the petitioner, will have to approach the Civil Court. Therefore, there is no merits in this Writ Petition. However, the petitioner can approach the Civil Court in terms of the above decision. 5. With the above observations, this Writ Petition stands dismissed. There shall be no order as to costs.
