Heard Sri Dilip Kumar Pandey, learned counsel for the applicant, learned AGA for the State of U.P. and Dr. Sanjay Kumar Singh, learned counsel for the opposite party No. 2 as well as perused the record. This application has been filed by the applicant assailing the order dated 10.06.2025 passed by the Additional Sessions Judge/F.T.C.-Second, Raebareli, whereby, the application Number 6Kha preferred by the accused/applicant under Section 227 Cr.P.C./250 B.N.S.S. seeking discharge related to Sessions Trial No. 600/2024 arising out of Case Crime No. 132/2024, under Sections- 376, 323, 504, 354, 506 IPC, Police Station- Kotwali Nagar, District- Raebareli, has been rejected. After taking note of the statements of victim recorded in terms of Sections 161 and 164 Cr.P.C., on being confronted, learned counsel for the applicant, after arguing the matter at some length, says that he may be permitted to withdraw the instant application. The aforesaid has not been opposed. In view of the above, the instant application is dismissed as withdrawn. Office is directed to return certified/original copies of the documents annexed with this application to the learned counsel for the applicant as per relevant Rules in this regard.
