ORAL ORDER The petitioner seeks for the following reliefs;
"a) Direct the respondents to consider the notice dated 07.12.2023 bearing No.Aa3/Anadhi.Shale/59(c)/2023-24 and representations dated 14.12.2023, 16.12.2023 and representations dated 20.01.2024 and 29.01.2024 vide Annexure- J, K, L, M and N respectively. b) Direct the respondents to continue the recognition of the institution and c) Further direct the respondents to extend all the benefits to which the institution run by the petitioner would be entitled to in pursuance of the
order passed on W.P.14071/2024 (EDN-RES) dated 19.08.2024 Vide ANNEXURE-AB. d) Consequential relief or any other appropriate order or direction as this Hon'ble Court deems fit in the
facts and circumstances of the case in the ends of justice and equity."
2. Heard learned counsel Sri Parthasarathi M.S., for the petitioner and learned Additional Government Advocate Smt. Mamatha Shetty for the respondents and perused the material on record.

The petitioner is a Society running an educational institution under the name and style of "Mahila Seva Samaja High School" after obtaining permission from the respondents while substituting high school classes for the Middle School Classes for the Academic Year 1937-38 by an order dated 31.07.1937. The Primary Wing of the institution which has been running since 1930 is catering to the needs of the students of the locality. After the Education Act and the Rules under the Act came into force on 29.07.2009, recognition was granted from the year 2007-08 to 2011-12. The management intended to expand in addition to the existing classes with the State syllabus wanting to seek permission for running CBSE classes and as such preferred an application for obtaining No Objection from the respondents for the Academic Year 2006-07. The petitioner approached this Court in Writ Petition No.14071/2024 seeking for quashing of the endorsement dated 25.06.2024 issued by the Block Education Officer and further direction to the respondents to allow the institution to run in terms of the Registration

Certificate dated 18.06.2007 and also sought to quash the portion of the memorandum dated 13.04.2023 issued by the Commissioner for Public Instructions, School Education and Literacy Department and to the extent of observing that after no objection being granted, the permission/ registration of the institution run with the State Board Syllabi would be automatically cancelled. This Court on
consideration of the impugned endorsement dated 25.06.2024 and the Circular dated 13.04.2023 issued by the respondents passed the following order, which reads as under;
"(i) Petition is hereby allowed. (ii) The impugned Endorsement at Annexure-AA dated 25.06.2024 issued by the 5th respondent is hereby quashed. (iii) It is declared and held that paragraph No.7 of the impugned Circular at Annexure- AB / Annexure-R2 dated 13.04.2023 as well as Bye-law 2.4.13 of the CBSE Affiliation Bye-laws, 2018 are not applicable to the Schools / Institutions run by the petitioner. (iv) The challenge to the impugned circular at Annexure-AB / Annexure-R2 dated 13.04.2023 are kept open to be decided in

appropriate case and no opinion is expressed on the same. (v) The respondents are directed not to interfere/ disturb or cause any obstruction / hindrance to the running of the schools / Institutions run by the petitioner by placing reliance upon either the CBSE Bye-laws or the impugned Circular dated 13.04.2023."

order, this Court quashed the endorsement issued by the Block Education Officer and declared and held that para 7 of the Circular dated 13.04.2023 and as well as Bye-law 2.4.13 of the CBSE Affiliation Bye-laws are not applicable to the petitioner institutions the circular reads as under;

5. As well as the Bye-law 2.4.13 of the CBSE Affiliation Bye-laws, 2018 which reads as under;
"2.4.13 DUAL AFFILIATION A school affiliated with the Board is not allowed to have dual affiliation i.e.

simultaneous affiliation with two boards with the same set of infrastructure and land. In case the affiliation has been granted under switch over category, the school is required to withdraw it students from the classes of the board to which it was earlier affiliated, in a phased manner."
5.1 The respondents were further directed not to interfere, disturb or cause any obstruction / hindrance to the running of the schools/institutions run by the petitioner by placing reliance upon either by the CBSE Bye-laws or the impugned Circular dated 13.04.2023 and this Court by the order dated 19.08.2024 held that the petitioner is entitled to run classes under both SSLC Board and CBSE Board as they establish separate / distinct portions of the land with necessary infrastructure has been provided for running both SSLC Board and CBSE Board.
5.2 Pursuant to the order passed by this Court, the petitioner gave representation to the concerned authorities to include the institution run by the management in the list of recognized schools and to extend all the entitlement to

which the institution would be eligible being recognized as educational institutions. The petitioner by number of representations at Annexure- J, K, L, M and N submitted which have not been considered and the petitioner institution is not placed in the list of authorized schools which made the petitioner approach this Court in this writ petition. 6. Learned AGA appearing for the respondents/State submits that the representations of the petitioner would be considered within a time bound manner. 7. The submission is recorded. The grievance of the petitioner would be meted, if necessary direction is issued to the respondents to consider the same in accordance with law within a time bound manner bearing in mind the decision of this Court in Writ Petition No.14071/2024 and this Court pass the following;

ORDER (i) Writ petition is disposed of. (ii) Respondents are directed to consider the representations of the petitioner at Annexure-J, K, L, M and N in terms of the decision of this Court in Writ Petition No.14071/2024 and pass appropriate orders within an outer limit of two weeks from the date of receipt of this order.
