Neutral Citation No. - 2025:AHC-LKO:41707 Court No. - 14 Case :- CRIMINAL MISC ANTICIPATORY BAIL APPLICATION U/S 438 CR.P.C. No. - 799 of 2025 Applicant :- Arvind Kumar Singh Opposite Party :- State Of U.P. Thru. Prin. Secy. Home Deptt. Lko. And Another Counsel for Applicant :- Anjali Dubey,Soniya Mishra Soni Pathak Counsel for Opposite Party :- G.A. Hon'ble Karunesh Singh Pawar,J. The present anticipatory bail application has been filed seeking anticipatory bail in F.I.R./Case Crime No.428 of 2019, under Sections-419,420,467,468,471 I.P.C., Police Station- Kotwali, District- Unnao. Heard learned counsel the applicant and learned A.G.A. for the State.
Learned counsel for the applicant submits that the applicant is neither the seller nor the purchaser, nor was he a witness to the sale deed in question. The offences alleged are triable by a Magistrate. The applicant undertakes to cooperate with the investigation and has no prior criminal record. On the other hand, learned AGA opposes the anticipatory bail application, stating that the named accused, in collusion with managerial staff including Devendra Singh Bahdoriya, Purnima Singh, and Nitin Kumar, have misappropriated public funds. The applicant's involvement appears evident, and custodial interrogation is necessary, as the case indicates the operation of a cartel in which the applicant is seemingly a participant. Upon considering the submissions made and the fact that public fund of Rs. 36,00,000/- has been misappropriated, it cannot be said that the applicant has been falsely implicated or targeted
merely to harm his reputation. The offence is punishable with life imprisonment. No ground for granting anticipatory bail is made out. Accordingly, the application is dismissed.
