Ram Lal Vs. Nipun Jindal & Anr. CMP No. 13265 of 2025 in COPC No. 329 of 2025 16.06.2025 Present: Mr. Ashok Kumar, Advocate, for the petitioner. Mr. V.S.Kanwar, Advocate, for the respondents. Though by way of instant application, prayer has been made on behalf of applicant/petitioner to revive the contempt Petition No. 329 of 2025 titled as Ram Lal Vs. Nipun Jindal, which was disposed on 23.04.2025 on the basis of statement made by learned counsel representing the respondent that mandate contained in the judgment, alleged to have been violated, if not already complied with, be complied within three weeks, but since needful was not done, as taken note herein above, applicant/petitioner has approached this Court in the instant application, praying therein to revive the contempt petition and take appropriate action against the respondents-contemnors. Before notices could be issued to the respondents in the instant application, Mr. V.S.Kanwar, Advocate, while putting in appearance on behalf of respondents has made available copy of office order dated 28.05.2025, issued under the signatures of Managing Director, HRTC, Shimla, state that respondents, after having found that case of the petitioner fulfills all requisite criteria for grant of pensionary and other retiral benefits, directed the Finance and Pension branch of the Corporation to do the needful in terms of mandate contained in the judgment, alleged to have been violated. Having taken note of aforesaid office order, this Court finds that mandate contained in the judgment, alleged to have been violated, stands complied with and as such, nothing remains to be adjudicated in the instant application and accordingly, the same is disposed of with a direction to the respondents to ensure that consequential benefits in terms of aforesaid compliance, if not already released, shall be released expeditiously, preferably within four weeks, failing which, applicant/petitioner would be at liberty to file appropriate proceedings in appropriate Court of law against erring officials.
