The present application under Section 482 Cr.P.C. has been filed for the following main relief:- "Wherefore, it is most respectfully prayed that this Hon'ble Court may kindly be pleased to quash the impugned charge sheet no. 01 of 2023 dated 05.08.2022 submitted in Criminal Case No.90486 of 2022; State versus Abhishek alias Ankur Verma arises out in Crime No. 0082 of 2022, under section 4/25 Arms Act, Police Station Aminabad, District Lucknow as well as summoning order dated 27.09.2022 passed by learned Additional Chief Judicial Magistrate (A.P.), Lucknow by which summon the petitioner for facing trial in Case No. 90486 of 2022, State versus Abhishek alias Ankur Verma arises out in Crime No.0082 of 2022, under section 4/25 Arms Act, Police Station Aminabad, District Lucknow, as contained in Annexure No. 1 and 2 respectively to this petition." At the very outset learned counsel for the applicant states that on account of some formal defects he may be permitted to withdraw the application with liberty to the applicant to avail the remedy provided under law including filing of discharge application before the court concerned, which may be decided expeditiously. Accordingly, the instant application is dismissed as withdrawn with the liberty as prayed for.
