Applicant has sought transfer of petition for restitution of conjugal rights, filed by respondent (husband), from Court of Civil Judge (Senior Division), Karnprayag, District Chamoli to Family Court, Kashipur, District Udham Singh Nagar. 3. It is submitted that marriage between the parties was solemnised on 05.03.2018, and a son was born out of the said wedlock on 18.02.2023, who is residing with applicant and she is looking after the child. 4. It is submitted that applicant is living with her parents at Kundeshwari, Tehsil Kashipur, District Udham Singh Nagar and Karnprayag, where the petition for restitution of conjugal rights is pending, is at a distance of more than 200 kilometers. Thus, it is submitted that it is not feasible for the applicant to visit Karnprayag on each and every date fixed in the matter. 5. Mr. Mukesh Rawat, learned counsel appearing for respondent, on instructions, 2025:UHC:3992 submits that he has no objection to the prayer for transfer, made by applicant and Suit No. 70 of 2023 may be transferred from Karnprayag to Kashipur. 6. For the aforesaid reason, Transfer Application is allowed. 7. Proceedings of petition for restitution of conjugal rights, filed by respondent, pending before the Court of Civil Judge (Senior Division), Karnprayag, District Chamoli, which was numbered as Suit No. 70 of 2023, is hereby transferred to a Court of competent jurisdiction at Kashipur, District Udham Singh Nagar. 8.
