Neutral Citation No. - 2025:AHC-LKO:41149 Court No. - 14 Case :- CRIMINAL MISC ANTICIPATORY BAIL APPLICATION U/S 438 CR.P.C. No. - 796 of 2025 Applicant :- Aditya Singh @ Aditya Narayan Singh And 2 Others Opposite Party :- State Of U.P. Thru. Addl. Chief Secy. Home Deptt. Lko. And Another Counsel for Applicant :- Prem Prakash Singh Counsel for Opposite Party :- G.A. Hon'ble Karunesh Singh Pawar,J. The present anticipatory bail application has been filed by the applicants seeking anticipatory bail in Case Crime No.306/2017, under Sections 147, 342, 364 I.P.C., P.S.Maharajganj, District Faizabad. Heard learned counsel for the applicants and learned A.G.A. for the State. A perusal of the record indicates that the applicants, in collusion with the co-accused, abducted bus driver Gulam Saiyad and conductor Virendra Kumar at gunpoint. The charge sheet in the matter was filed on 24.12.2018. The case diary reflects that summons were issued to the accused on the same date, i.e., 24.12.2018. Non-bailable warrants were also issued against the applicants. The applicants have been evading arrest since 2018. The offence under Section 364 IPC is of a serious nature, and there is nothing on record to suggest that the applicants have been falsely implicated. It is pertinent to note that the bus, along with the abducted driver and conductor, was recovered by the police on the next day. Moreover, the regular bail application of co-accused Hari Kesh Singh @ Mintoo has already been rejected by the Sessions Court.
Considering the prolonged abscondence of the applicants since 2018, the gravity of the offence, and the statements of the prosecution witnesses, this Court finds no ground that it is a case of false implication. Accordingly, no case for grant of anticipatory bail is made out. The anticipatory bail application stands rejected. Order Date :- 18.7.2025 R.C.
