Neutral Citation No. - 2025:AHC-LKO:41278 Court No. - 14 Case :- CRIMINAL MISC. ANTICIPATORY BAIL APPLICATION U/S 482 BNSS No. - 877 of 2025 Applicant :- Mohammad Haneef Opposite Party :- State Of U.P. Thru. Prin. Secy. Home Deptt. Lko. And Another Counsel for Applicant :- Afaq Zaki Khan,Alimulla Khan Counsel for Opposite Party :- G.A. Hon'ble Karunesh Singh Pawar,J. 1. Heard learned counsel for applicant, learned A.G.A. for the State and perused the record. 2. First application for anticipatory bail has been filed under Section 438 Cr.P.C./ 482 BNSS with regard to Case Crime No.301 of 2025, under Sections 3(5), 109 BNS, Sections 3/5/8 of Cow Slaughter Protection Act, Sections 11(1)(d) of Prevention of Cruelty to Animals Act and Section 3/25 Arms Act, P.S. Safdarganj, District Barabanki. 3. A perusal of the record shows that three co-accused persons in their statement given to the police have stated that applicant is the largest recipient of the profit. Allegation against the applicant as well as co-accused is that 17 bovine animals which include one dead bull, one dead cow along with remaining 15 animals and 315 bore country made pistol, 2 empty cartridges, 1 live cartridge of 315 bore have been recovered. Applicant is the owner of the vehicle. 4. Considering the recovery made and the fact that applicant is the owner of the vehicle and the statement of three co-accused persons i.e. the largest recipient of the profit earned from selling these animals cannot be said that it is a case of false implication and hence no case for anticipatory bail is made out. The anticipatory bail application is dismissed. Order Date :- 18.7.2025 Saurabh Yadav/- Digitally signed by :- SAURABH YADAV High Court of Judicature at Allahabad, Lucknow Bench
