2. The Court made the following ORDER:
Heard Sri A.Lalith Nikhil, learned counsel for the petitioner and Sri Ajay, learned Assistant Government Pleader for Home for respondents 3 & 4.
2. The above writ petition is filed to declare the action of the 2nd respondent in not issuing/renewing the passport in pursuance of the petitioner’s passport application vide No.VJ2076670955724 due to the pendency of FIR No.229 of 2024 of Cumbum Police Station, Prakasam District, as illegal and arbitrary.
3. At the hearing, the learned Assistant Government Pleader for Home would submit that, in pursuance of the crime registered by the 4th respondent,

the police filed a final report before the Additional Judicial First Class Magistrate, Giddalur. The learned Magistrate has taken cognisance in C.C.No.272/2025, and the case is posted to 10.06.2025 for the appearance of the accused. Learned AGP would submit that the petitioner has to make an application before the jurisdictional Magistrate.
4. In reply, learned counsel for the petitioner would submit that the petitioner will make an application in C.C.No.272 of 2025 pending on the file of the learned Additional Judicial First Class Magistrate, Giddalur.
5. Given the facts and circumstances, the writ petition is disposed of giving liberty to the petitioner to make an application in C.C.No.272 of 2025 on the file of the learned Additional Judicial First Class Magistrate, Giddalur. If such an application is filed by the petitioner, the learned Magistrate shall consider and pass appropriate orders keeping in view Rule 12 of the Passport Rules
1980. No order as to costs. As a sequel, pending miscellaneous petitions, if any, shall stand closed.
