The present application has been filed by the applicants/appellants for condonation of delay in filing the present appeal.
It has been averred in the application that the impugned judgment and decree was passed by the learned District Judge on29.10.2024 and the copy of impugned judgment and decree was applied on 29.10.2024 itself and the same was prepared on 13.11.2024 and delivered on the same day. Thereafter, the District Attorney, Bilaspur along with letter intimated the department that appropriate appeal which was pending before the learned District Judge, Bilaspur was dismissed. On receipt of the letter of District Attorney, the Superintendent Engineer, Jhandutta, sent the matter for legal opinion and thereafter, the case was processed through different channels and in this process, the delay has occurred in filing the present appeal.
The explanation, as given in the application, particularly in paras No. 2 and 3 of the application, is reasonable and plausible.
In view of the averments made in the application, which are duly supported by an affidavit, as also the submissions made by the learned Additional Advocate General, the delay in filing the appeal is condoned. The application stands disposed of.
